Ultralunch: Section 962 - The "How To" Session

Here’s what will be covered:

  • How GILTI is taxed. You’ll get the high-level theory stuff, plus we will follow a dollar of GILTI from Form 5471 all the way through to Form 1040 so you can see what the tax return looks like.
  • How Subpart F is taxed. Same thing: theory and gruesome line-by-line tracing of a dollar of income from the CFC all the way through to a tax liability on the shareholder’s Form 1040.
  • Dividends. This is the thing that sucks about Section 962. We will embrace the suck and follow a CFC dividend from the CFC all the way through to Form 1040.
  • Foreign tax credit. Individuals get to claim indirect foreign tax credit, just like corporations. Doesn’t it feel a bit janky to be using Form 1118 on a Form 1040? Let’s do it anyway.
  • Basis. What does all of this do to the shareholder’s basis in the shares?
  • Earnings and Profits. We will dive deep into calculating earnings and profits.
